WHAT IS A BAIL BOND?

 Bail is the monetary guarantee required by the Court in order to release a Defendant from custody and to guarantee his or her appearance in Court as the Court directs. Once a bail bond is posted and the Defendant is released, it then becomes the Bail Bonding Agency's responsibility for that Defendant's appearance in Court. If the Defendant fails to comply with the conditions set by the Court then warrants are issued and the bail bond forfeited. The Courts will then demand full value of the bond from the bail bond agency. The bail bond agency then will do whatever is necessary to return the Defendant to custody in order to recover their costs.
 

WHERE AND WHEN CAN BAIL BONDS BE POSTED?

Bail Bonds can be posted at most jails 24 hours a day, 7 days a week: however, certain jails will not allow bonds to be posted after 10 pm.

 

 

HOW MUCH DOES A BAIL BOND COST?

 State laws regulate what can be charged for bail bond premiums. In most cases, premiums are set at 10% of the full bail amount that the Court set.  Out-of- state bonds and capital crime bonds (if a bond is set by the court) require 15% of the full bail amount set by the Court. Out-of-country residents require full cash collateral equal to the face value of the bond set by the Courts as well as the normal bond premium. Other fees include a $50 processing fee and may include a $25 fee, in those counties where required.  This is also known as a "turnkey fee" that is paid directly to the jail for each bond posted.

HOW LONG DOES IT TAKE TO ACQUIRE DEFENDANT’S RELEASE?

After all paperwork has been completed, the Bail Agent will post the Bail Bond to the proper jail or court.  The amount of time to process the defendant for release varies based on the workload of the jail and/or court.  After the bail bond has been posted, the Bail Agent will notify you of the timeline for the Defendant's release.

 

                              IS THE BAIL BOND PREMIUM REFUNDABLE?
Once a bail bond has been posted, liability has been fully assumed on the bond. When liability has been fully assumed, the bail bond has been fully earned and is non-refundable.

WHO IS LIABLE FOR THE BAIL BOND?
The Indemnitor (Co-Signor) is 100% liable for the full face value of the bail bond if the Defendant fails to appear in Court or fails to meet any of the conditions set by the Court and/or the Bail Bonding Agency. It is very important that the Indemnitor feel confident that the Defendant will appear to all of his or her court appearances OR posting a bail bond is not advised.
 

HOW LONG IS A BAIL BOND ACTIVE?

A Misdemeanor or Felony Bail Bond is considered "ACTIVE" in most cases for a period of 3 years or for a period of 5 years on Appeal Bonds unless your case has been satisfactorily discharged beforehand.
